BEWARE T-MOBILE!!!!

This has absolutely nothing to do with the decline of democrats, but I am damned mad and want people to know about this scam.

Background:

Three and a half years ago my wife and I set up a t-mobile family plan. Two phones and 600 shared minutes. It took a two year contract and we got the phones for free. Everyone's familiar with this.

Liked the service, liked the plan, everything was hunky dory.

Last year I went WAY over our plan limit due to business and got wacked with a whopper of a bill. My fault.

I called immediately to increase my plan minutes and tried to negotiate some new phones, but sorry no. "Free new phones are only for new accounts." Okay, I just upped my monthly minutes and monthly bill because at the time there was really nothing better and I figured I could live with the old phones a while longer.

Outrage:

This year I just decided to switch to Cingular figuring that their acquisition of AT-T cell towers would probably make them the most reliable in the US. We took our numbers with us (very cool) and got two new phones which are hugely better than the nearly 4 year old t-mobile Nokia's we had been using.

I just got my final bill from t-mobile today. There was a HUGE "Contract Cancellation" fee on it.

WHAT???!!!!!!

We had been with them for almost 4 years!!! Contract Termination Fee!!! What the hell is that!!!

Disturbing Answer

When I called today to say WTF! I was told that last year when I increased my monthly limit that I had agreed to another year of contracted service.

ME: "I did not agree to that and no one explained that increasing my monthly minutes would create an entirely new service obligation."

t-mobile clerk: "It was recorded and it was a legally binding verbal contract. You switched your service 12 days before your contract ran out."

Needless to say I was a bit put out.

ME: "Wait a minute. Your telling me that in this age where cell phone companies are giving away free phones at the drop of the hat, giving millions of incentives to change service, I'm going to agree to another year of obligatory service to t-mobile and I got..... um.... NOTHING!!!!????? I would have simply switched my service to another company for their 'It's free with new service and a contract' come on."

t-mobile clerk: "Its recorded."

ME: "Okay, play the recording with the clerk reading me the contract clause and my voice saying I understand and accept."

t-mobile clerk: "Can you hold please?."

ME: "Sure."

tap tap tap tap tap

t-mobile clerk: "Okay, I talked to my boss and we are going to wave the 'contract termination fee', but we're going to charge you for service to the end of your contract."

ME: "WHAT!!!! You're going to charge me for service during a period of time when I didn't have it!!! What sort of an ass do you think I am!!!???? I'm not paying a penny until you play that recording of me accepting the terms of a contract!!!"

t-mobile clerk: "We have it recorded."

ME: "Recorded how!!!"

t-mobile clerk: "The clerk that helped you typed into the notes that she read you the contract terms and that you agreed to them."

ME: "You.. You... You have a $10 an hour clerk's typed NOTES that I agreed!!!!!!! You don't have a recording of ME saying that I agree!!!!!"

t-mobile clerk: "No."

ME: "Then you don't have a legally binding VERBAL contract!!!!"

t-mobile clerk: "Yes we do."

ME: "How do you figure??!!"

t-mobile clerk: "We have the clerk's notes in the file that she read the contract to you and that you agreed to the terms."

ME: "I'm telling you she didn't!!!!"

t-mobile clerk: "It's recorded."

ME: "Play me the recording!!!!"

t-mobile clerk: "It's documented."

ME: "By the notes of a $10 an hour clerk!!!???? What if she blew it and forgot to read that to me and after she hung up she simply typed it into the record to save her job!!!????"

t-mobile clerk: "Look, I wasn't there..."

ME: "That's right, but I was!!! I'm telling you that I knew nothing about it and I'm not paying either the termination fee or for service I didn't receive!!"

t-mobile clerk: "Well, I'm sorry things ended this way."

ME: "Ended? No, no. Just started. I'm a blogger and you might want to let your superiors know that."

I will continue to update as I get more "information" from t-mobile. In the meantime, if you make any changes to your t-mobile account, to include changing your email address, your ring tone, your cell phone face or your speed dial list, you may want to have your attorney present to review any "hidden" consequences of those changes.

The Vice Presidential Debitchslap

Dick Cheney more than bitchslapped John Edwards last night. Edwards spent the evening trying to derail Cheney by misdirection and insult, but Cheney ignored the little twit and pounded home the messages that he wanted to get across.

Edwards desperation became extremely apparent when he lowered himself to dragging Cheney's gay daughter into the debate to try and anger Cheney into losing his temper.

Cheney handled the slimy insult by thanking the little pissant for saying nice things about his family and nothing more.

Edwards looked like he had been hit in the back of the head with a two by four.

Edwards didn't even answer the majority of questions posed to him by the moderator, but instead used his time to rail and rant about issues that he obviously had little knowledge of.

I was embarrassed for Edwards as Cheney calmly pointed this out and then stuck to the topics at hand.

Overall, I am left wondering if Edwards was able to find all of the teeth that Cheney knocked out before he went home last night.

Blithering Blather Blasted by Bloggers

Blather's time has come. Even his co-journalists are trying to get out of the blast zone. An article in The Washington Post cites:

"Even inside CBS News there was deepening concern. Some of Mr. Rather's colleagues said in interviews that they were becoming increasingly anxious for him to silence the critics by proving the documents' validity and as new questions about their origin arose. Most declined to be quoted by name."

Turns out that ultra-liberal, totally biased Mary Mapes has used her position at Can't Be Sure (CBS) news to try and put the Dumpocraps in office by fraud.

Not only has Can't Be Sure lost all credibility as a news organization, but they have crossed the line between media and politics. I feel they should immediately join the ranks of Al-Jazeera in the hall of dictatorial shame.

Bradbury vs US Constitution

My email to the Oregon Secretary of State:

Mr. Bradbury,
We hereby call for your immediate resignation for blatantly interfering with the electoral process of this United States of America by intentionally exceeding your authority. Your blatant attempt to refuse Ralph Nader a spot on the state ballot by misrepresenting the qualification process makes you incompetent to hold public office. If you refuse, we will commence impeachment procedures against you. You have seriously miscalculated the impact of the internet in oversight of public officials such as yourself.You must resign immediately.

Their prompt reply:

Dear Sir or Madam,

Secretary of State Bill Bradbury will not resign nor apologize for fairly and evenly enforcing the laws of the state of Oregon. In accordance with the Marion County judge's ruling, Ralph Nader is currently on the ballot. The Secretary of State is appealing that decision, not because of Nader, but because we have heard from the people of Oregon that they are concerned about fraud in the election system and we are determined to enforce rules that keep our elections free of fraud.

Yeah, even rules they make up to keep Democratic "spoilers" off the ballot.
